1. Acceptance of Terms

By accessing or using Texas Lead Engine’s website, applications, and services (collectively, the “Services”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Services.

2. Description of Services

Texas Lead Engine provides business intelligence tools including business health scoring, financial analysis, and advisory dashboards. Our Services integrate with third-party platforms, including Intuit QuickBooks Online, to deliver financial insights to authorized users.

3. Account Registration

Certain features require authentication. You are responsible for maintaining the confidentiality of your credentials and for all activities under your account. You agree to notify us immediately of any unauthorized use.

4. QuickBooks Integration

By connecting a QuickBooks Online account to Texas Lead Engine, you acknowledge that:

  • You have the authority to grant Texas Lead Engine access to the connected QuickBooks company file.
  • Texas Lead Engine will access financial data (Profit & Loss, Balance Sheet reports) solely for the purpose of generating health assessments and advisory insights.
  • You may revoke access at any time by disconnecting QuickBooks through the Texas Lead Engine dashboard or through your Intuit account settings.
  • Texas Lead Engine’s use of QuickBooks data is subject to Intuit’s Developer Terms of Service.

5. Acceptable Use

You agree not to:

  • Use the Services for any unlawful purpose
  • Attempt to gain unauthorized access to our systems or other users’ data
  • Reverse engineer, decompile, or disassemble any part of the Services
  • Use automated tools to scrape, harvest, or extract data from the Services
  • Interfere with or disrupt the integrity or performance of the Services

6. Lead Data & Business Information Products

Certain Services (including Texas Lead Engine) provide business information compiled from Texas public records and other publicly available sources. With respect to this data, you acknowledge and agree that:

  • The data is provided “as-is” and “as-available.” We do not warrant its accuracy, completeness, currency, or fitness for any particular purpose.
  • The data is refreshed periodically (generally weekly) and is not represented as real-time. Public records may contain errors or omissions outside our control.
  • You are solely responsible for your use of the data and for complying with all applicable laws and regulations governing outreach, marketing, and contact — including but not limited to the CAN-SPAM Act, the Telephone Consumer Protection Act (TCPA), and applicable Do-Not-Call rules. We are not responsible for how you use the data.
  • The data is licensed for your internal business use and may not be resold, redistributed, or sublicensed without our written consent.
  • If you are an individual or business listed in our data and wish to be removed, you may request suppression at any time by emailing [email protected]. We will honor verified removal requests promptly.

You agree to indemnify and hold Texas Lead Engine harmless from any claims arising out of your use of the data, including any use that violates applicable law or third-party rights.

7. Intellectual Property

All content, features, and functionality of the Services — including but not limited to the proprietary health scoring algorithm, user interface designs, and data visualizations — are owned by Texas Lead Engine and protected by applicable intellectual property laws. You may not copy, modify, or distribute any part of the Services without our written consent.

8. Data and Privacy

Your use of the Services is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Services, you consent to the practices described in the Privacy Policy.

9. Disclaimers

The Services are provided “as is” and “as available” without warranties of any kind, either express or implied. Texas Lead Engine does not guarantee the accuracy, completeness, or timeliness of any information provided through the Services.

Health scores and financial insights are informational tools only and do not constitute financial, legal, or tax advice. You should consult qualified professionals before making business decisions based on information from our Services.

10. Limitation of Liability

To the maximum extent permitted by law, Texas Lead Engine shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of the Services.

11. Termination

We may suspend or terminate your access to the Services at any time, with or without cause, with or without notice. Upon termination, your right to use the Services ceases immediately. Provisions that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) will survive.

12. Modifications

We reserve the right to modify these Terms at any time. Material changes will be communicated through the Services or by email. Your continued use of the Services after changes are posted constitutes acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of Lubbock County, Texas.
